Public Act 113 of 2011 amended section 205 of the Michigan Zoning Enabling Act, PA 110 of 2006, by adding mining-related provisions, which provide, in part, that a zoning and ordinance shall not prevent the extraction, by mining, of valuable natural resources from any property unless very serious consequences would result from the extraction of those natural resources.

This program will cover the effect of the 'Very Serious Consequences' rule on local zoning authority over mining activity. It will also provide a refresher on other restrictions on zoning authority.
